DECLARATION DE CONFIDENTIALITE RELATIVE À LA PROTECTION DES DONNÉES À CARACTÈRE PERSONNEL DES CANDIDATS A UN EMPLOI

PLUXEE BELGIUM S.A. est une société anonyme appartenant au Groupe PLUXEE (ci-après, « PLUXEE » ou « Nous »). La présente Déclaration de confidentialité (ci-après “la Déclaration”) contient des informations importantes sur le traitement de vos Données à caractère personnel personnelles lorsque vous postulez à un emploi auprès de PLUXEE.

1. OBJET DE LA PRÉSENTE DÉCLARATION

L’objectif de la présente Déclaration est de vous informer de la façon dont nous collectons, utilisons et traitons vos Données à caractère personnel. Cette Déclaration décrit également les mesures que nous prenons afin d’assurer la protection de vos Données à caractère personnel et précise comment vous pouvez nous contacter afin que nous puissions répondre à vos éventuelles questions au sujet de la protection de vos Données à caractère personnel.

PLUXEE s’engage à respecter l’ensemble des dispositions réglementaires et législatives applicables en matière de protection des Données à Caractère telles que le Règlement général sur la protection des données 2016/679 et les lois nationales sur la protection des données, PLUXEE souhaite préciser quels types des Données à caractère personnel sont collectés, et comment vos données seront utilisées et avec qui les Données à caractère personnel sont partagées. Elle énonce également vos droits en ce qui concerne vos Données à caractère personnel.

Dans cette Déclaration, on entend par :

“ Donnée à caractère personnel ” (ci-après, ‘Données à caractère personnel’, ‘Données personnelles’ ou ‘Données’) : toute information se rapportant à une personne physique identifiée ou identifiable (ci-après dénommée «personne concernée»); est réputée être une «personne physique identifiable» une personne physique qui peut être identifiée, directement ou indirectement, notamment par référence à un identifiant, tel qu'un nom, un numéro d'identification, des données de localisation, un identifiant en ligne, ou à un ou plusieurs éléments spécifiques propres à son identité physique, physiologique, génétique, psychique, économique, culturelle ou sociale.
“ Pays tiers” : Tout pays, territoire ou secteur défini dans ledit pays, en dehors de l’Union européenne (UE) et de l’Espace économique européen (EEE).
“ Règlement Général sur la Protection des données à caractère personnel ou RGPD ou Règlementation” : Règlementation (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 sur la protection des personnes physiques en ce qui concerne le traitement des données à caractère personnel et la libre circulation de ces données, qui remplace la Directive 95/46/CE.
“Responsable du traitement des données” : la personne physique ou morale, l'autorité publique, le service ou tout autre organisme qui, seul ou conjointement avec d'autres, détermine les finalités et les moyens du traitement.
“Traitement de Données à caractère personnel” : Toute opération ou tout ensemble d'opérations effectuées ou non à l'aide de procédés automatisés et appliquées à des données ou des ensembles de données à caractère personnel, y compris, sans s’y limiter, la collecte, l'enregistrement, l'organisation, la structuration, la conservation, l'adaptation ou la modification, l'extraction, la consultation, l'utilisation, la communication par transmission, la diffusion ou toute autre forme demise à disposition, le rapprochement ou l'interconnexion, la limitation, l'effacement ou la destruction.

2. Portée de la présente Déclaration

Destinataire de cette Déclaration
Cette Déclaration s'applique :

aux candidats à l'emploi qui postulent via la section “Jobs” de notre site internet ;
aux candidats dont le profil nous est communiqué par nos partenaires (agences d’intérim, bureau de recrutement, etc.) et plateformes partenaires d’aide au recrutement ;
à tout candidat à un emploi qui entre en contact avec PLUXEE dans le cadre d'une candidature à un emploi (par exemple, les candidatures spontanées) ;
à tout candidat dont le profil est exposé à Pluxee par tout autre biais (références, réseaux sociaux, etc.).

Dans la mesure où PLUXEE est susceptible de collecter et de traiter des Données de tiers que vous lui avez communiquées, nous vous demandons de bien vouloir informer lesdits tiers de l'existence de cette Déclaration afin qu'ils puissent prendre connaissance du traitement que PLUXEE effectue sur leurs Données et de leurs droits.

4. Données à caractère personnel collectées

Lorsqu'un candidat postule pour un emploi chez PLUXEE, les Données à caractère personnel suivantes peuvent être collectées et traitées :

Données d'identification (prénom, nom, date de naissance, nationalité, etc.) ;
Information de contact ;
Parcours scolaire et formations ;
Références ;
Détails de l'interview ;
Détails de l'expérience professionnelle (emploi postulé, niveau de fonction, compétences acquises, etc.) ;
Informations sur le droit du demandeur à travailler en Belgique ;
Salaire et avantages souhaités ;
Photos et vidéos (volontairement communiquées par le candidat via les CV ou collectées via notre système de caméras de surveillance).

De manière générale, les Données à caractère personnel que PLUXEE traite seront directement communiquées par vous, par le biais de vos curriculum vitae, lettre de motivation ou lors d'entretiens, via des tests de préférences auxquels vous vous soumettez ou autres formes d'évaluation.

PLUXEE recueille également des Données à caractère personnel de tiers, tels que des agences de recrutement ou via des chasseurs de tête. Si la réglementation ou la législation l'autorise, PLUXEE peut également recevoir des informations sur vous de la part d'anciens employeurs ou de personnes de référence si vous donnez votre consentement, ou de sources accessibles au public ou réseaux sociaux, telles que LinkedIn.

5. Pourquoi PLUXEE recueille-t-elle ces informations ?

5.1. Procédure de sélection et de recrutement

PLUXEE recueille les Données à caractère personnel pour évaluer, examiner et traiter les candidatures aux postes vacants ou les candidatures spontanées, contacter le candidat et conclure un éventuel contrat de travail. Le traitement des Données à caractère personnel d'un candidat est donc justifié et nécessaire dans le cadre du processus de recrutement et en vue de l’exécution de mesures précontractuelles ou sur la base de l'intérêt légitime de PLUXEE.

À ce titre, PLUXEE peut collecter et traiter les catégories de Données énoncées à l’article 4.

En particulier, ces Données peuvent être collectées auprès d'anciens employeurs si vous avez donné votre consentement.

5.2. Enregistrement de vos Données dans une réserve de recrutement

PLUXEE conserve les données de candidats non-retenus dans une réserve de recrutement pendant une période de deux ans à compter du dernier contact avec ledit candidat sur la base de l’intérêt légitime de PLUXEE, qui est celui de pouvoir contacter les candidats qui n'ont pas été retenus afin de leur proposer de nouvelles offres d'emploi dès que des postes vacants se libèrent au sein de PLUXEE.

A cette fin, PLUXEE peut collecter et traiter les catégories de Données énoncées à l’article 4.

Le candidat peut s’opposer à tout moment à ce traitement ou demander l’effacement de ses Données à caractère personnel.

5.3. Assurer la sécurité des biens et des personnes

PLUXEE utilise un système de caméras de surveillance mis à disposition par le propriétaire de l'immeuble où sont situés les bureaux. Ces caméras de surveillance situées dans le bâtiment sont uniquement destinées à assurer la sécurité des biens et des personnes et à prévenir toute intrusion.

Dans ce contexte, les catégories de Données suivantes seront traitées :

Images (photos/vidéos prises par le biais de notre système de caméras de surveillance).

Les images recensées par le biais des caméras de surveillance sont conservées durant un laps de temps spécifique évoqué au point 8 de la présente Déclaration.

6. La base juridique du traitement des Données à caractère personnel

Les Données à caractère personnel mentionnées ci-dessus sont traitées et collectées uniquement dans la mesure où elles sont nécessaires pour atteindre les objectifs décrits dans l'article 5.

Conformément à l'article 6 du RGPD, PLUXEE n'utilisera et ne traitera vos Données que si les conditions suivantes sont remplies :

L'utilisation de vos Données est nécessaire pour effectuer les étapes nécessaires de la procédure de recrutement et, le cas échéant, pour conclure un contrat avec vous (phase pré-contractuelle et contractuelle).
Vous avez consenti à l'utilisation de vos Données. Dans la mesure où nous traitons vos informations personnelles sur la base de votre consentement, vous avez le droit de retirer votre consentement à tout moment. Vous pouvez le faire en nous contactant (voir infra).
L'utilisation de vos Données pendant le processus de recrutement est nécessaire dans le cadre des intérêts légitimes de PLUXEE. Lorsque PLUXEE traite vos Données pour satisfaire ses intérêts légitimes, elle veille à ce qu'un juste équilibre soit trouvé entre vos droits et libertés fondamentaux, y compris votre vie privée, et son ou ses intérêts légitimes.
Enfin, dans certains cas, PLUXEE est légalement tenue de traiter certaines Données en vertu de certaines obligations légales, et le cas échéant de les divulguer aux autorités compétentes. Par exemple, elle est tenue de vérifier l'admissibilité d'un candidat retenu à travailler en Belgique avant le début de son emploi.

7. Comment vos informations seront-elles utilisées et partagées

PLUXEE peut partager vos Données à caractère personnel avec des entités liées et appartenant au Groupe dont elle fait partie.

Dans des circonstances spécifiques, PLUXEE peut partager vos informations personnelles avec des tiers qui exercent des fonctions en son nom et lui fournissent des services, tels que des agences d’intérim ou des bureaux de recrutement.

PLUXEE peut divulguer vos Données à caractère personnel pour se conformer à ses obligations légales ou dans l'intérêt de la sécurité, de l'intérêt public ou de l'application de la loi. Elle peut également divulguer des Données dans le cadre d'un litige réel ou potentiel ou pour protéger sa propriété, sa sécurité, ses collaborateurs et autres droits ou intérêts.

Vos Données à caractère personnel ne seront pas vendues ou louées à des tiers.

8. Transfert de vos Données à caractère personnel en dehors de l'UE/EEE

Compte tenu du caractère international du groupe PLUXEE, vos Données à Caractère Personnel sont susceptibles d’être transférées à des destinataires, internes au groupe PLUXEE ou externes, autorisés à exécuter des services pour notre compte.

En principe, PLUXEE ne transfère pas de Données à caractère personnel en dehors de l'Union européenne (UE) ou de l'Espace économique européen (EEE). Si PLUXEE prévoit de les stocker et/ou de les traiter en dehors de l'UE/EEE, elle doit s'assurer qu’un niveau de protection adéquat c’est-à-dire équivalent à celui applicable au sein de l’UE ou de l’EEE est garanti.

Si un transfert de vos Données à caractère personnel doit avoir lieu vers des pays tiers, PLUXEE prendra toutes les mesures nécessaires et appropriées pour garantir la sécurité et la confidentialité de vos Données à caractère personnel transférées et ainsi assurer un niveau de protection équivalent à celui en vigueur au sein de l’Union européenne ou de l’Espace Economique Européen. Un tel transfert sera notamment encadré par l’un des mécanismes prévus au Chapitre V du RGPD (décision d’adéquation, Clauses Contractuelles Types, règles d’entreprise contraignantes etc.).

9. Combien de temps conservons-nous vos Données à caractère personnel ?

Si votre candidature à un emploi n'est pas retenue, PLUXEE conservera vos Données à caractère personnel pendant une période de deux ans à compter du dernier contact avec le candidat non-retenu afin d'envisager d'autres possibilités d'emploi, sauf si vous vous y opposez.

Si votre candidature est retenue et que vous voyez offrir un poste chez PLUXEE, les Données à caractère personnel recueillies au cours du processus de recrutement seront transférées dans votre dossier personnelet conservées pendant la durée de votre emploi. La période pendant laquelle vos Données seront conservées en tant que collaborateur vous sera communiquée dans une Déclaration distincte destinée aux collaborateurs.

Les images issues des caméras de surveillance sont conservées pendant une période d’un mois, conformément à la loi, sauf demande contraire des autorités compétentes.

10. Sécurité des Donnée

Vos Données sont considérées comme strictement confidentielles. À cette fin, nous avons pris toutes les mesures techniques et organisationnelles appropriées pour les protéger contre toute destruction, perte ou altération accidentelle ainsi que contre tout dommage, accès accidentel ou illicite ou autre traitement injustifié des Données.

Nous prenons toutes les mesures raisonnables en vertu des principes du respect de la vie privée dès la conception (« privacy by design ») et de la protection de la vie privée par défaut (« privacy by default ») aux fins de mettre en place les garanties nécessaires et de sécuriser le Traitement des Données à caractère personnel. Selon le niveau de risque présenté par le Traitement, nous réalisons également une analyse d’impact relative à la protection des données à caractère personnel (« privacy impact assessment ») aux fins d’adopter les mesures de protection adéquates et de garantir la protection des Données à caractère personnel des candidats qui postulent à un emploi chez PLUXEE.

11. Droits des personnes concernée

Vous disposez de certains droits relatifs aux Données à caractère personnel que nous détenons à votre sujet :

Droit d'être informé : vous avez le droit d'être informé, au plus tard au moment de la collecte de vos Données, sur le traitement que nous effectuons, vos droits y afférents et l'exercice de ces droits. A ce titre, nous avons rédigé la présente Déclaration.
Droit d'accès : vous avez le droit de consulter les informations vous concernant et d'obtenir une copie des informations que nous détenons.
Droit de rectification : vous pouvez nous demander de rectifier, compléter ou supprimer les Données périmées, incorrectes ou incomplètes que nous détenons à votre sujet.
Droit d'effacement : dans certaines circonstances, vous avez le droit d'obtenir l'effacement des Données à caractère personnel que nous détenons à votre sujet, par exemple lorsque ces Données à caractère personnel ne sont plus nécessaires aux fins pour lesquelles elles ont été collectées ou lorsque vous avez retiré votre consentement et qu'il n'existe aucune autre base juridique pour le traitement des Données.
Droit d'opposition et de restriction : dans certaines circonstances, vous avez le droit de demander la limitation du traitement de vos Données à caractère personnel. PLUXEE peut ainsi arrêter temporairement et/ou partiellement le traitement qui est effectué. Vous pouvez arrêter définitivement un traitement déterminé ou tous les traitements que PLUXEE effectue sur vos Données à caractère personnel en faisant appel au droit d’opposition.
Droit à la portabilité : À la demande d'un candidat et à condition que cela soit techniquement possible, PLUXEE doit fournir aux candidats une copie de ses Données à caractère personnel traitées, dans un format numérique, lisible et structuré. Ainsi, les candidats peuvent les sauvegarder pour une(ré)utilisation personnelle, ou demander au Responsable du traitement de les transférer à un autre Responsable du traitement. La législation sur la protection des Données limite ce droit quant aux Données qui ont été initialement fournies à PLUXEE par le candidat lui-même.
Droit d’introduire une réclamation : Vous pouvez décider d’introduire une réclamation auprès de l’Autorité de contrôle de la protection des données du pays de votre résidence habituelle. Pour la Belgique il s’agit de l’Autorité de protection des données (APD, 1000 Bruxelles, Rue de la Presse 35 – contact@apd-gba.be). Vous avez également le droit d’introduire une action en justice devant les tribunaux du pays dans lequel l’entité PLUXEE dispose d’un établissement ou du pays où se trouve votre résidence habituelle.

Afin de nous assurer de l’identité de la personne qui émet la demande d’exercice de droit ou d’information portant sur ses Données à caractère personnel, nous procédons à la vérification dans nos systèmes de l’identité de la personne à l’origine de la demande. En cas de doute raisonnable quant à l’identité de la personne qui émet la demande d’exercice de droit, nous pouvons demander que des informations supplémentaires nous soient communiquées pour confirmer l’identité de la personne concernée.

L’exercice de vos droits en vertu du RGPD est gratuit sauf si nous considérons que la demande est manifestement infondée ou excessive (par exemple, en cas de demandes répétées ou intempestives).

Nous répondrons à votre demande dans le délai légalement prescrit par le RGPD, à savoir, un mois à compter de la réception de votre demande. Ce délai peut être prolongé et porté à deux mois supplémentaires si la demande s’avère complexe et/ou en raison du nombre de demandes que nous devons traiter. Si ledit délai doit être prolongé, vous en serez averti ainsi que du motif de cette prolongation.

Veuillez noter que dans certaines circonstances prévues par la loi, nous pouvons refuser l’accès à vos informations ou ne pas donner droit à votre demande lorsque nous y sommes légalement autorisés ou obligés. En cas de demande manifestement infondée ou excessive, nous pouvons également refuser de faire droit à votre (vos) demande(s).

12. Modification de cette Déclaration

Nous nous réservons le droit de modifier ou de compléter cette Déclaration si nécessaire.

En cas de modifications importantes, la date de modification sera mise à jour et une copie de la nouvelle Déclaration sera publiée sur notre Site internet.

PLUXEE BELGIUM N.V. is een naamloze vennootschap die deel uitmaakt van de PLUXEE Groep (hierna "PLUXEE" of "Wij"). Deze Privacyverklaring ("Verklaring") bevat belangrijke informatie over de Verwerking van uw Persoonsgegevens wanneer u solliciteert voor een baan bij PLUXEE.

1. DOEL VAN DEZE VERKLARING

Het doel van deze Verklaring is om u te informeren over hoe wij uw Persoonsgegevens verzamelen, gebruiken en verwerken. In deze Verklaring :

"Persoonsgegevens" (hierna, "Persoonsgegevens" of "Gegevens" genoemd) betekent alle informatie betreffende een geïdentificeerde of identificeerbare natuurlijke persoon (hierna "betrokkene" genoemd); een "identificeerbare natuurlijke persoon" is een persoon die direct of indirect kan worden geïdentificeerd, met name aan de hand van een identificator, zoals een naam, een identificatienummer, locatiegegevens, een online identificator, of van een of meer specifieke elementen die kenmerkend zijn voor zijn of haar fysieke, fysiologische, genetische, psychische, economische, culturele of sociale identiteit.
"Derde land" betekent elk land, gebied of gedefinieerde sector buiten de Europese Unie (EU) en de Europese Economische Ruimte (EER).
"Algemene Verordening Gegevensbescherming of AVG of GDPR" betekent Verordening (EU) 2016/679 van het Europees Parlement en de Raad van 27 april 2016 betreffende de bescherming van natuurlijke personen in verband met de Verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens, die Richtlijn 95/46/EG vervangt.
"Verwerkingsverantwoordelijke" betekent de natuurlijke of rechtspersoon, overheidsinstantie, dienst of enig ander orgaan die, alleen of samen met anderen, het doel van en de middelen voor de Verwerking vaststelt.
"Verwerking van persoonsgegevens" betekent elke bewerking of elk geheel van bewerkingen met betrekking tot persoonsgegevens of een geheel van persoonsgegevens, al dan niet uitgevoerd met behulp van geautomatiseerde procedés, met inbegrip van, maar niet beperkt tot het verzamelen, vastleggen, ordenen, structureren, bewaren, bijwerken, wijzigen, opvragen, raadplegen, gebruiken, verstrekken door middel van doorzending, verspreiden of op enigerlei andere wijze ter beschikking stellen, samenbrengen, met elkaar in verband brengen, beperken, wissen of vernietigen van Gegevens.

2. Toepassingsgebied van deze Verklaring

Deze Verklaring is van toepassing op :

sollicitanten die zich aanmelden via het gedeelte "Vacatures" op onze website;
kandidaten waarvan we de profielen ontvangen van onze partners (uitzendbureaus, wervingsbureaus, enz.) en partnerplatforms voor hulp bij werving en selectie;
elke sollicitant die in contact komt met PLUXEE als onderdeel van een sollicitatie (bijv. ongevraagde sollicitaties);
elke kandidaat wiens profiel op enige andere wijze (referenties, sociale netwerken, etc.) aan Pluxee bekend is gemaakt.

Voor zover PLUXEE Gegevens kan verzamelen en verwerken van derden die u haar hebt meegedeeld, verzoeken wij u vriendelijk deze derden op de hoogte te brengen van het bestaan van deze Verklaring, zodat zij op de hoogte zijn van de Verwerking die PLUXEE uitvoert op hun Gegevens en van hun rechten.

4.Verzamelde Persoonsgegevens

Wanneer een kandidaat solliciteert voor een baan bij PLUXEE, kunnen de volgende Persoonsgegevens worden verzameld en verwerkt:

Identificatiegegevens (voornaam, achternaam, geboortedatum, nationaliteit, enz;
Contactgegevens ;
Onderwijs en opleiding ;
Referenties ;
Details van het interview;
Details van de beroepservaring (functie waarnaar wordt gesolliciteerd, functieniveau, verworven vaardigheden, enz);
Informatie over het recht van de aanvrager om in België te werken ;
Verwachtingen met betrekking tot salaris & extra-legale voordelen;
Foto's en video's (vrijwillig verstrekt door de kandidaat via cv's of verzameld via ons bewakingscamerasysteem).

In het algemeen worden de Persoonsgegevens die PLUXEE verwerkt rechtstreeks door u meegedeeld, via uw curriculum vitae, sollicitatiebrief of tijdens sollicitatiegesprekken, via voorkeurstests waaraan u zich onderwerpt of andere vormen van evaluatie.PLUXEE verzamelt ook Persoonsgegevens van derden, zoals wervingsbureaus of headhunters. Indien toegestaan door de wet- of regelgeving, kan PLUXEE ook informatie over u ontvangen van voormalige werkgevers of referenten indien u daar toestemming voor geeft, of van publiek beschikbare bronnen of sociale netwerken, zoals LinkedIn.

5. Waarom verzamelt PLUXEE deze informatie

5.1. Selectie- en wervingsprocedure

PLUXEE verzamelt Persoonsgegevens om sollicitaties op vacatures of open sollicitaties te evalueren, te onderzoeken en te verwerken, om contact op te nemen met de sollicitant en om een eventuele arbeidsovereenkomst af te sluiten. De Verwerking van Persoonsgegevens van een kandidaat is daarom gerechtvaardigd en noodzakelijk in het kader van het wervingsproces en voor de uitvoering van precontractuele maatregelen of op basis van het gerechtvaardigd belang van PLUXEE.

Hiertoe kan PLUXEE de in artikel 4 genoemde categorieën van Persoonsgegevens verzamelen en verwerken.

Deze Gegevens kunnen met name worden verzameld van voormalige werkgevers als u daarvoor toestemming hebt gegeven.

5.2. Uw Gegevens opslaan in een wervingsreserve

PLUXEE bewaart de Gegevens van niet-geselecteerde kandidaten in een wervingspool gedurende een periode van twee jaar vanaf het laatste contact met de kandidaat in kwestie op basis van het gerechtvaardigd belang van PLUXEE, namelijk om niet-geselecteerde kandidaten te kunnen contacteren om hen nieuwe vacatures aan te bieden zodra er vacatures vrijkomen binnen PLUXEE.

Hiertoe kan PLUXEE de in artikel 4 genoemde categorieën van Gegevens verzamelen en verwerken.

Sollicitanten kunnen te allen tijde bezwaar maken tegen deze Verwerking of verzoeken om verwijdering van hun Persoonsgegevens.

5.3. Zorgen voor de veiligheid van mensen en eigendommen

PLUXEE maakt gebruikt van een bewakingscamerasysteem ter beschikking gesteld van de eigenaar van het kantoorgebouw. Het bewakingscamerasysteem in het gebouw heeft als enige doel de veiligheid van mensen en eigendommen te garanderen en inbraak te voorkomen

In deze context worden de volgende categorieën Gegevens verwerkt:

Beelden (foto's/video's gemaakt met ons bewakingscamerasysteem).

De door de bewakingscamera's opgenomen beelden worden gedurende een specifieke periode bewaard, zoals vermeld in punt 8 van deze Verklaring.

6. De rechtsgrondslag voor het verwerken van Persoonsgegevens

De hierboven vermelde Persoonsgegevens worden alleen verwerkt en verzameld voor zover dit noodzakelijk is om de in artikel 5 beschreven doelstellingen te bereiken.

In overeenstemming met Artikel 6 van de GDPR zal PLUXEE uw Gegevens alleen gebruiken en verwerken als aan de volgende voorwaarden is voldaan:

Het gebruik van uw Gegevens is noodzakelijk om de nodige fasen van de wervingsprocedure uit te voeren en, een eventueel contract met u te sluiten (precontractuele en contractuele fase).
U hebt toestemming gegeven voor het gebruik van uw Gegevens. Voor zover wij uw persoonsgegevens verwerken op basis van uw toestemming, hebt u het recht om uw toestemming te allen tijde in te trekken. U kunt dit doen door contact met ons op te nemen (zie hieronder).
Het gebruik van uw Gegevens tijdens het wervingsproces is noodzakelijk voor de legitieme belangen van PLUXEE. Wanneer PLUXEE uw Gegevens verwerkt om haar legitieme belangen te behartigen, zal PLUXEE ervoor zorgen dat er een eerlijk evenwicht wordt gevonden tussen uw fundamentele rechten en vrijheden, met inbegrip van uw privacy, en haar legitieme belangen.
Ten slotte is PLUXEE in bepaalde gevallen wettelijk verplicht om bepaalde Gegevens te verwerken op grond van bepaalde wettelijke verplichtingen en, indien van toepassing, deze bekend te maken aan de bevoegde autoriteiten. Zo is PLUXEE bijvoorbeeld verplicht om de geschiktheid van een succesvolle kandidaat om in België te werken te verifiëren vóór de indiensttreding.

7. Hoe wordt uw informatie gebruikt en gedeeld?

PLUXEE kan uw Persoonsgegevens delen met verwante entiteiten die behoren tot de Groep waartoe zij behoort.

In specifieke omstandigheden kan PLUXEE uw persoonlijke Gegevens delen met derden die namens ons functies uitvoeren en diensten aan ons verlenen, zoals uitzendbureaus of wervingsbureaus.PLUXEE kan uw Persoonsgegevens openbaar maken om te voldoen aan haar wettelijke verplichtingen of in het belang van de veiligheid, het algemeen belang of wetshandhaving.

PLUXEE kan ook Gegevens openbaar maken in verband met feitelijke of potentiële rechtszaken of om haar eigendom, veiligheid, werknemers en andere rechten of belangen te beschermen.

Uw Persoonsgegevens worden niet verkocht of verhuurd aan derden.

8.Overdracht van uw Persoonsgegevens buiten de EU/EER

Gezien het internationale karakter van de PLUXEE-groep, kunnen uw Persoonsgegevens worden doorgegeven aan ontvangers, intern binnen de PLUXEE-groep of extern, die gemachtigd zijn om diensten voor onze rekening uit te voeren.

In principe geeft PLUXEE geen Persoonsgegevens door buiten de Europese Unie (EU) of de Europese Economische Ruimte (EER). Als PLUXEE van plan is om Persoonsgegevens buiten de EU/EER op te slaan en/of te verwerken, moet zij ervoor zorgen dat een passend beschermingsniveau, d.w.z. gelijkwaardig aan het niveau dat van toepassing is binnen de EU of de EER, wordt gewaarborgd.

Indien een overdracht van uw Persoonsgegevens naar derde landen moet plaatsvinden, zal PLUXEE alle noodzakelijke en passende maatregelen nemen om de veiligheid en vertrouwelijkheid van uw overgedragen Persoonsgegevens te waarborgen en zo een beschermingsniveau te garanderen dat gelijkwaardig is aan het niveau dat van kracht is binnen de Europese Unie of de Europese Economische Ruimte. In het bijzonder zal een dergelijke overdracht geregeld worden door een van de mechanismen voorzien in Hoofdstuk V van de AVG (adequaatheidsbesluit, modelcontractbepalingen, bindende bedrijfsregels, enz.)

9. Hoe lang bewaren we uw Persoonsgegevens?

Als uw sollicitatie niet succesvol is, zal PLUXEE uw Persoonsgegevens bewaren voor een periode van twee jaar vanaf het laatste contact met de afgewezen sollicitant om andere arbeidsmogelijkheden te overwegen, tenzij u hiertegen bezwaar maakt.

Als uw sollicitatie succesvol is en u een functie bij PLUXEE krijgt aangeboden, worden de Persoonsgegevens die tijdens de wervingsprocedure zijn verzameld, overgedragen naar uw persoonlijke dossier en bewaard voor de duur van uw dienstverband. De periode gedurende dewelke uw Persoonsgegevens als werknemer zullen worden bewaard, zal u worden meegedeeld in een aparte Verklaring voor werknemers.

10. Beveiliging van Persoonsgegeven

Uw Persoonsgegevens worden als strikt vertrouwelijk beschouwd. Daarom hebben we alle passende technische en organisatorische maatregelen genomen om deze te beschermen tegen onopzettelijke vernietiging, verlies of wijziging, evenals tegen beschadiging, onopzettelijke of ongeoorloofde toegang of andere ongerechtvaardigde Verwerking van de Persoonsgegevens.

Wij nemen alle redelijke stappen in overeenstemming met de beginselen van privacy by design en privacy by default om de nodige waarborgen in te stellen en de Verwerking van Persoonsgegevens te beveiligen. Afhankelijk van het risico dat de Verwerking met zich meebrengt, voeren we ook een effectbeoordeling gegevensbescherming uit om de juiste beschermingsmaatregelen te nemen en de bescherming van de Persoonsgegevens van kandidaten die solliciteren naar een baan bij PLUXEE te garanderen.

11. Rechten van de betrokkenen

U hebt bepaalde rechten met betrekking tot de Persoonsgegevens die wij over u verwerken :

Recht op informatie: u hebt het recht om uiterlijk op het moment dat uw Gegevens worden verzameld, geïnformeerd te worden over de Verwerking die wij uitvoeren, uw rechten in verband hiermee en hoe u deze rechten kunt uitoefenen. Hiertoe hebben wij deze Verklaring opgesteld.
Recht op toegang: u hebt het recht om de informatie die op u betrekking heeft te raadplegen en om een kopie te krijgen van de informatie die wij bewaren.
Recht op rectificatie: u kunt ons vragen verouderde, onjuiste of onvolledige Gegevens die wij over u bewaren te rectificeren, aan te vullen of te verwijderen.
Recht op wissen: in bepaalde omstandigheden hebt u het recht om Persoonsgegevens die wij over u bewaren te laten wissen, bijvoorbeeld wanneer deze Persoonsgegevens niet langer nodig zijn voor de doeleinden waarvoor ze zijn verzameld of wanneer u uw toestemming hebt ingetrokken en er geen andere wettelijke basis is voor de Verwerking van de Persoonsgegevens.
Recht van verzet en beperking: in bepaalde omstandigheden hebt u het recht om de beperking van de Verwerking van uw Persoonsgegevens te vragen. PLUXEE kan daarom de Verwerking tijdelijk en/of gedeeltelijk stopzetten. U kunt een specifieke Verwerking of alle Verwerkingen die PLUXEE op uw Persoonsgegevens uitvoert, definitief stopzetten door uw recht op verzet uit te oefenen.
Recht op overdraagbaarheid: Op verzoek van een sollicitant en op voorwaarde dat het technisch mogelijk is, moet PLUXEE sollicitanten een kopie van hun verwerkte Persoonsgegevens bezorgen in een digitaal, leesbaar en gestructureerd formaat. Op deze manier kunnen sollicitanten deze opslaan voor persoonlijk (her)gebruik, of de Verwerkingsverantwoordelijke vragen deze over te dragen aan een andere Verwerkingsverantwoordelijke. De wetgeving inzake gegevensbescherming beperkt dit recht tot Persoonsgegevens die aanvankelijk door de sollicitant zelf aan PLUXEE werden verstrekt.
Recht om een klacht in te dienen: U kunt besluiten een klacht in te dienen bij de Gegevensbeschermingsautoriteit in het land waar u woont. In België is dat deGegevensbeschermingsautoriteit (Gegevensbeschermingsautoriteit, 1000 Brussel, Pressestraat 35 - contact@apd-gba.be). U hebt ook het recht om gerechtelijke stappen te ondernemen voor de rechtbanken van het land waar de PLUXEE entiteit een vestiging heeft of van het land waar uw gewone verblijfplaats zich bevindt.

U kunt deze rechten te allen tijde en zonder rechtvaardiging uitoefenen of contact met ons opnemen met een verzoek of klacht met betrekking tot de bescherming van uw Persoonsgegevens. Neem hiervoor contact met ons op via een van de volgende kanalen:

Geef bij uw verzoek duidelijk aan op welk recht u zich wilt beroepen en welke Verwerking van Persoonsgegevens u wilt tegenhouden of beperken of welke toestemming u wilt intrekken.

Om de identiteit vast te stellen van de persoon die het verzoek indient om een recht uit te oefenen of om informatie te verkrijgen over zijn Persoonsgegevens, controleren wij de identiteit van de persoon die het verzoek indient in onze systemen. Als er gerede twijfel bestaat over de identiteit van de persoon die het verzoek indient, kunnen wij om aanvullende informatie vragen om de identiteit van de betrokken persoon te bevestigen.

Het uitoefenen van uw rechten onder de GDPR is gratis, tenzij we van mening zijn dat het verzoek duidelijk ongegrond of buitensporig is (bijvoorbeeld in het geval van herhaalde of ontijdige verzoeken).

We zullen op je verzoek reageren binnen de periode die wettelijk is voorgeschreven door de AVG, d.w.z. één maand na ontvangst van je verzoek. Deze termijn kan worden verlengd tot nog eens twee maanden als het verzoek complex is en/of vanwege het aantal verzoeken dat wij moeten verwerken. Als de genoemde termijn moet worden verlengd, wordt u hiervan op de hoogte gesteld en van de reden voor de verlenging.

Houd er rekening mee dat we in bepaalde omstandigheden waarin de wet voorziet, toegang tot uw Persoonsgegevens kunnen weigeren of niet aan uw verzoek kunnen voldoen wanneer we wettelijk gemachtigd of verplicht zijn om dit te doen. In het geval van een duidelijk ongegrond of buitensporig verzoek, kunnen we ook weigeren uw verzoek(en) in te willigen.

12.Wijziging van deze Verklaring

We behouden ons het recht voor om deze Verklaring indien nodig te wijzigen of aan te vullen.

Bij belangrijke wijzigingen wordt de wijzigingsdatum bijgewerkt en wordt een kopie van de nieuwe Verklaring gepubliceerd op onze Website.

We raden u aan deze Verklaring regelmatig te raadplegen om te weten te komen hoe we uw Gegevens verwerken en beschermen.

PRIVACY NOTICE RELATING TO THE PROTECTION OF PERSONAL DATA OF JOB APPLICANTS

PLUXEE BELGIUM S.A. is a public limited company belonging to the PLUXEE Group (hereinafter, "PLUXEE" or "We"). This Privacy notice ("Privacy notice") contains important information about the processing of your Personal Information when you apply for a job with PLUXEE.

1. PURPOSE OF THIS PRIVACY NOTICE

The purpose of this Privacy notice is to inform you about how we collect, use and process your Personal Information. This Privacy notice also describes the measures we take to ensure the protection of your Personal Data and specifies how you can contact us so that we can answer any questions you may have about the protection of your Personal Data.

PLUXEE is committed to complying with all applicable regulatory and legislative provisions on the protection of Personal Data such as the General Data Protection Regulation 2016/679 and national data protection laws. PLUXEE wishes to clarify what types of Personal Data are collected, and how your Data will be used and with whom Personal Data is shared. It also sets out your rights in relation to your Personal Data.

In this Notice :

"Personal Data" (hereinafter, "Personal Data" or "Data") means any information relating to an identified or identifiable natural person (hereinafter referred to as the "Data Subject"); an "identifiable natural person" is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

job applicants whose profiles we receive from our partners (temporary employment agencies, recruitment agencies, etc.) and partner recruitment assistance platforms;
any job applicant who comes into contact with PLUXEE as part of a job application (e.g. unsolicited applications);
any job applicant whose profile is made known to PLUXEE by any other means (references, social networks, etc.).

Insofar as PLUXEE is likely to collect and process Data from third parties that you have communicated to it, we kindly ask you to inform such third parties of the existence of this Privacy notice so that they may be aware of the processing that PLUXEE carries out on their Data and of their rights.

4. Personal Data collected

When a job applicant applies for a job with PLUXEE, the following Personal Data may be collected and processed:

Identification data (first name, surname, date of birth, nationality, etc.) ;
Contact information ;
Education and training ;
References ;
Details of the interview;
Details of professional experience (job applied for, level of function, skills acquired, etc.) ;
Information on the applicant's right to work in Belgium ;
Expected salary and benefits ;
Photos and videos (voluntarily communicated by the job applicant via CVs or collected via our surveillance camera system)

In general, the Personal Data that PLUXEE processes will be communicated directly by you, via your resume (curriculum vitae), application letter or during interviews, via preference tests to which you submit yourself or other forms of evaluation.

PLUXEE also collects Personal Data from third parties, such as recruitment agencies or headhunters. Where permitted by regulation or legislation, PLUXEE may also receive information about you from former employers or referees if you give your consent, or from publicly available sources or social networks, such as LinkedIn.

5. Why does PLUXEE collect this information?

5.1. Selection and recruitment procedure

PLUXEE collects Personal Data in order to evaluate, examine and process applications for vacancies or spontaneous applications, to contact the applicant and to conclude a possible employment contract. The processing of a job applicant's Personal Data is therefore justified and necessary as part of the recruitment process and for the performance of pre-contractual measures or on the basis of PLUXEE's legitimate interest.

To this end, PLUXEE may collect and process the categories of Data set out in article 4.

In particular, this Data may be collected from former employers if you have given your consent.

5.2. Storing your Data in a recruitment reserve

PLUXEE retains the data of unsuccessful job applicants in a recruitment pool for a period of two years from the last contact with the said job applicant on the basis of PLUXEE's legitimate interest, which is to be able to contact unsuccessful job applicants in order to offer them new job opportunities as soon as vacancies become available within PLUXEE.

To this end, PLUXEE may collect and process the categories of Data set out in article 4.

Applicants may object to this processing at any time or request that their Personal Data be deleted.

5.3. Ensuring the safety and security of people and property

PLUXEE uses a surveillance camera system provided by the owner of the building where the offices are located. These surveillance cameras in the building are only intended to ensure the safety of people and property and to prevent any intrusion.

In this context, the following categories of Data will be processed:

Images (photos/videos taken via our surveillance camera system).

The images recorded by the surveillance cameras are kept for a specific period of time as mentioned in point 8 of this Privacy notice.

6. The legal basis for processing Personal Data

The Personal Data mentioned above is processed and collected only insofar as it is necessary to achieve the objectives described in article 5.

In accordance with Article 6 of the GDPR, PLUXEE will only use and process your Data if the following conditions are met:

The use of your Data is necessary to carry out the necessary stages of the recruitment procedure and, where applicable, to conclude a contract with you (pre-contractual and contractual phase).
You have consented to the use of your Data. Insofar as we process your Personal Data on the basis of your consent, you have the right to withdraw your consent at any time. You can do this by contacting us (see below).
The use of your Data during the recruitment process is necessary for PLUXEE's legitimate interests. Where PLUXEE processes your Data to satisfy its legitimate interests, it will ensure that a fair balance is struck between your fundamental rights and freedoms, including your privacy, and its legitimate interest(s).
Finally, in certain cases, PLUXEE is legally required to process certain Data by virtue of certain legal obligations, and where applicable to disclose it to the competent authorities. For example, PLUXEE is required to verify the eligibility of a successful job applicant to work in Belgium prior to the commencement of employment.

7. How will your Personal Data be used and shared

PLUXEE may share your Personal Data with related entities belonging to the Group to which it belongs.

In specific circumstances, PLUXEE may share your Personal Data with third parties who perform functions on our behalf and provide services to us, such as temporary employment agencies or recruitment agencies.PLUXEE may disclose your Personal Data to comply with its legal obligations or in the interest of safety, public interest or law enforcement.

PLUXEE may also disclose Data in connection with actual or potential litigation or to protect its property, safety, employees and other rights or interests.

Your Personal Data will not be sold or rented to third parties

8. Transfer of your Personal Data outside the EU/EEA

Given the international nature of the PLUXEE group, your Personal Data may be transferred to recipients, whether internal to the PLUXEE group or external, authorised to perform services on our behalf.

In principle, PLUXEE does not transfer Personal Data outside the European Union (EU) or the European Economic Area (EEA). If PLUXEE plans to store and/or process it outside the EU/EEA, it must ensure that an adequate level of protection, i.e. equivalent to that applicable within the EU or the EEA, is guaranteed.

If a transfer of your Personal Data must take place to third countries, PLUXEE will take all necessary and appropriate measures to guarantee the security and confidentiality of your Personal Data transferred and thus ensure a level of protection equivalent to that in force within the European Union or the European Economic Area. In particular, any such transfer will be governed by one of the mechanisms provided for in Chapter V of the GDPR (adequacy decision, Standard Contractual Clauses, binding corporate rules, etc.).

9. How long do we keep your Personal Data?

If your application for employment is unsuccessful, PLUXEE will retain your Personal Data for a period of two years from the last contact with the unsuccessful applicant in order to consider other employment opportunities, unless you object.

If your application is successful and you are offered a position at PLUXEE, the Personal Data collected during the recruitment process will be transferred to your personal file and retained for the duration of your employment. The period for which your Data will be retained as an employee will be communicated to you in a separate Privacy notice for workers.

Images from surveillance cameras are kept for a period of one month, in accordance with the law, unless otherwise requested by the competent authorities.

10. Data security

Your Data is considered as strictly confidential. To this end, we have taken all appropriate technical and organisational measures to protect it against any accidental destruction, loss or alteration, as well as against any damage, accidental or illicit access or other unjustified processing of the Data.

We take all reasonable steps in accordance with the principles of privacy by design and by default to put in place the necessary safeguards and to secure the Processing of Personal Data. Depending on the level of risk presented by the Processing, we also carry out a privacy impact assessment in order to adopt the appropriateprotection measures and guarantee the protection of the Personal Data of job applicants applying for a job at PLUXEE.

11. Rights of job applicants

You have certain rights in relation to the Personal Data we hold about you:

Right to be informed: you have the right to be informed, at the latest at the time of collection of your Data, about the processing that we carry out, your rights relating thereto and how to exercise these rights. To this end, we have drawn up this Privacy notice.
Right of access: you have the right to consult the information concerning you and to obtain a copy of the information we hold.
Right of rectification: you may ask us to rectify, complete or delete any out-of-date, incorrect or incomplete Data we hold about you.
Right to erasure: in certain circumstances, you have the right to obtain the erasure of Personal Data we hold about you, for example where such Personal Data is no longer necessary for the purposes for which it was collected or where you have withdrawn your consent and there is no other legal basis for processing the Data.
Right of opposition and restriction: in certain circumstances, you have the right to request the restriction of the processing of your Personal Data. PLUXEE may therefore temporarily and/or partially stop the processing being carried out. You may definitively stop a specific processing operation or all processing operations carried out by PLUXEE on your Personal Data by exercising your right to object.
Right to Data portability: At the request of a job applicant and provided that it is technically possible, PLUXEE must provide job applicants with a copy of their Personal Data processed, in a digital, readable and structured format. In this way, job applicants can save them for personal (re)use, or ask the Data Controller to transfer them to another Data Controller. Data protection legislation limits this right to Data that was initially provided to PLUXEE by the applicant.
Right to lodge a complaint: You may decide to lodge a complaint with the Data Protection Supervisory Authority in your country of habitual residence. In Belgium this is the Data Protection Authority (DPA, 1000 Brussels, Rue de la Presse 35 - contact@apd-gba.be). You also have the right to take legal action before the courts of the country in which the PLUXEE entity has an establishment or of the country in which your habitual residence is located.

When making your request, please indicate clearly which right you wish to invoke and which Data processing you wish to oppose or limit or which consent you wish to withdraw.

In order to ascertain the identity of the person making the request to exercise a right or to obtain information about their Personal Data, we check the identity of the person making the request in our systems. If there is reasonable doubt regarding the identity of the person making the request, we may ask for additional information to confirm the identity of the person concerned.

Exercising your rights under the GDPR is free of charge unless we consider that the request is manifestly unfounded or excessive (for example, in the case of repeated or untimely requests).

We will respond to your request within the period legally prescribed by the GDPR, i.e. one month from receipt of your request. This period may be extended to a further two months if the request is complex and/or because of the number of requests we have to process. If the said period has to be extended, you will be notified of this and of the reason for the extension.

Please note that in certain circumstances provided for by law, we may refuse access to your information or not comply with your request where we are legally authorised or obliged to do so. In the event of a manifestly unfounded or excessive request, we may also refuse to grant your request(s).

We reserve the right to amend or supplement this Privacy notice if necessary.

In the event of significant modifications, the modification date will be updated and a copy of the new Privacy notice will be published on our Website.
